The new and emerging field of mold and sewage contamination has attracted many personal injury and building defect litigation attorneys. The have found themselves on both sides of the issues. It is important that anyone entering this field bring themselves up to speed on various aspects of the issues. Due to the unregulated nature of these hazards there is a lot of room for differences of opinion as to the degree of hazard and risk these conditions pose. The following are some general guidelines for attorneys entering this arena:
- Read all you can on the subject.
- Be up to speed on the process of abatement of mold problems
- Hire experts who have at least 2 to 5 years experience in mold litigation and have worked both sides. The actual number of qualified experts in this field in the United States in our opinion is less than 50.
- As with any expert make sure they are objective and they are basing their opinion on enough testing and inspection of the site in question.
- Make sure the laboratory being used to analyzed the samples is qualified and has the expertise. There are lot of new labs out in the marketplace with very little qualifications of experience.
- Make sure you name the laboratory as an expert. There have been a number of cases where the data was thrown out as heresy when the lab was not named.
